Heard counsel for the petitioner, learned standing counsel for respondent no. 1 & 2 and Sri Rajesh Kumar Yadav holding brief of Sri A.K. Srivastava, counsel for respondent no. 3.
The present writ petition has been filed by the petitioner seeking a direction in the nature of mandamus commanding respondent no. 2- Sub Divisional Officer, Sambhal to consider and decide petitioner's application for cancelling fair price shop licence of respondent no. 4- Smt. Sugra being in utter violation of the Govt. Order dated 18.7.2002 contained in annexure-1 to the writ petition.
Learned counsel for the petitioner contends of that Zareef Ahmad, Gram Pradhan is the brother-in-law (Devar) of respondent no. 4, who is fair price shop dealer at present and in view of the aforesaid Govt. Order, dealership of fair price shop cannot be given to blood relation of the Gram Pradhan. It is further submitted that petitioner has made an application in this regard to respondent no. 2 but no decision has been taken in the matter as yet.
After hearing learned counsel for the parties, the present petition is being finally disposed of by issuing a direction upon the S.D.O.- respondent no. 2 to consider and decide the petitioner's application, in accordance with law expeditiously within two months from the date of production of a certified copy of this order. No order as to costs.
