Vakalatnama filed by Sri Vidya Dhar Yadav, learned Advocate on behalf of respondent no.4 is taken on record.
The petitioner is aggrieved by non-release of gratuity since after 31.3.2017.
Sri M.K.Kushwaha, learned counsel for the respondent Corporation submits that necessary steps are being taken for release of gratuity and payment to the petitioner will be made within a period of one month.
There is no dispute about the entitlement of the petitioner to gratuity. However, it is contended that the petitioner being a muster roll employee was not entitled to gratuity earlier and later on in terms of the Government Order dated 18th July, 2014, even the muster roll employees had been made entitled to gratuity. Necessary steps have, thereafter, been taken to provide benefit of the Government Order to all employees who are covered by the same.
In view of the above, without expressing any opinion as to the merits of claim of the petitioner, the present writ petition is being disposed of with the direction to respondent no. 1 namely the Managing Director, U.P. State Bridge Corporation Ltd., Lucknow to make sure that withheld gratuity of the petitioner is released, at the earliest.
