No one is present on behalf of the appellant. Learned A.G.A. for the State-respondent is present.
Perusal of the report of Chief Judicial Magistrate, Kanpur Dehat dated 17.1.2019 indicates that appellant, Jageshwar has died in an accident on 04.12.2004 regarding which written Tehrir of village Pradhan, copy of F.I.R. has been annexed and the statement of Serving Officer S.I. Ravi Kumar Dangi and villagers namely Tulshi Ram and Pramod Kumar were also recorded.
I have perused the statement of witnesses and death certificate of appellant issued by village Pradhan, Chik report where from it is proved that the sole appellant-Jageshwar has died.
In view of above, the criminal appeal in respect of appellant, Jageshwar stands abated, consequently the appeal is dismissed as having abated.
