Heard learned counsel for the petitioner and learned Additional Government Advocate.
Under challenge in the writ petition is F.I.R. of Crime No. 356 of 2003 under Sections 409,420,418,467,468 and 471 I.P.C., Police Station Bihar,district Unnao.
We have gone through the contents of F.I.R. Since it discloses commission of cognizable offence, and as such, the same cannot be quashed. However, seeing that the petitioner has approached this Court after seven years,while disposing of this writ petition,we direct that the petitioner shall not be arrested in the aforesaid case crime number unless and until cogent and reliable evidence comes forward against him, which turns in the shape of report under Section 169/173 Cr.P.C. provided he cooperates with the investigation, which shall go on.
