Heard Sri Sunil Kumar Srivastava, learned counsel for the petitioner.
Learned Standing Counsel has accepted notice on behalf of respondent nos. 1, 2 and 3.
This petition has been filed for a direction to the Second Additional Civil Judge (Senior Division), Saharanpur to expeditiously decide Original Suit No. 521 of 2012 (Jagesh vs. State of U.P. and others) It appears that a suit for permanent injunction was filed by the petitioner. After exchange of pleadings, the issues were framed on 29.04.2015 and preliminary issues were decided. On 01.05.2019, the defendants were granted last opportunity for evidence.
Considering the facts and circumstances of the case, the court below is directed to proceed to expeditiously decide the aforesaid suit on merits, in accordance with law, preferably within a period of one year from the date of filing of a certified copy of this order before it.
With the aforesaid observation, the petition is disposed of.
