The present petition has been filed challenging the order dated 11.7.2018, whereby the services of the petitioner, which are on contract basis, have been dismissed.
The contention of learned counsel for the petitioner is that the order is prima facie stigmatic in nature and casts aspersion of the integrity of the petitioner and once such an order is proposed to be passed, it was incumbent to give an opportunity of hearing. No such opportunity has been given to the petitioner prior to passing of the said order.
Without going into the other averments of the petition, this Court finds that the order is ex facie stigmatic and appears to have been passed without observing the principles of natural justice. As such on that ground alone, the order dated 11.7.2018 is set aside with a liberty to the respondents to pass fresh orders in accordance with law, if they may so deem fit.
The petition is disposed off in terms of the said order.
Copy of the order downloaded from the official website of this Court shall be treated as certified copy of this order.
