The fair price shop licence was cancelled by order dated 15.3.2018. The petitioner took the order of termination in appeal. The appeal was registered as Appeal No.333 of 2018, Jagdish Vs. Sub-Divisional Magistrate, Siddharthnagar in the court of learned Commissioner, Basti Division, Basti. The appeal was instituted on 26.3.2018. The memo of appeal was accompanied by application for interim relief. The submission made by Shri D.K. Srivastava, learned counsel for the petitioner is that the application for interim relief has not been decided till date. Any further delay in a decision on the application for interim relief would defeat its purpose. The only prayer is that the application for interim relief may be decided within a stipulated period of time.
Learned Standing Counsel has no serious objection to the prayer being granted.
In view of the aforesaid facts, the respondent No.2 or any other authority before whom the aforesaid stay application is pending shall decide the stay application accompanying the memo of appeal within a period of 15 days from the date of receipt of a certified copy of this order.
With the aforesaid direction, the writ petition is disposed of.
