Heard, Shri Deepak Kumar Tripathi, learned counsel for the applicants, Sri Bhaiya Ghanshyam Singh, learned A.G.A. appearing for the State and perused the record.
This application under Section 482 Cr.P.C has been moved with a prayer this Hon'ble Court may be pleased to direct the Court below to expedite trial of the Case No. 82 of 2018 (State Vs. Jagdish Pasi and another) arising out of Case Crime No. 152 of 2018 under Sections 363, 376(2) (i), 376-D, 302, 201 IPC and 3/4 POCSO Act at Police Station Pipari, District Kaushambi pending before Additional District and Sessions Judge/Special Judge, POCSO Act within a stipulated period as may be fixed by this Court.
It is argued by the learned counsel for the applicants that the applicants are accused in this case. The trial against them is pending since 14.06.2018. Till date statements of three witnesses only have been recorded. Hence it is prayed that the Trial Court be directed to decide this case in a fixed time period.
In view of the above, this application under Section 482 Cr.P.C. is disposed off finally with a direction to the Court below to hear and decide the aforesaid case expeditiously, without granting unnecessary adjournments to either party except in exceptional circumstance, within a period of six months from the date of production of a certified copy of this order before it.
With the aforesaid observation, the application is disposed off. If the opposite party No. 2 feels any grievance by this order, he may approach this Court.
