Petitioner claims to have retired on 31.1.2018. At the time of his superannuation, petitioner was posted as Constable at Mathura. His grievance is that though a period of about 10 months are going to expire, but none of the retiral benefits due and payable to petitioner have been released to him.
Learned Standing Counsel submits that grievance of petitioner shall be examined, in accordance with law.
In the facts and circumstances, noticed above, this writ petition stands disposed of with a direction upon the respondent no.3 to accord consideration to petitioner's claim, as noticed above, and in case there is no legal hindrance, the authority concerned shall ensure release of retiral benefits to the petitioner, within a period of three months from the date of presentation of certified copy of this order, or else a specific order would be passed disclosing reasons for not releasing retiral benefits to the petitioner. In case the retiral benefits of petitioner are not released, within the aforesaid period, petitioner shall also be entitled to interest at the rate of 8% per annum, and the authorities shall be entitled to realize such amount from the salary of officer, who is found responsible for not complying with the directions issued.
