Heard Sri Pankaj Kumar Tiwari, learned counsel for the petitioner, learned Standing Counsel appearing for the State respondent nos.1,2 & 3 and perused the record.
By means of this writ petition under Article 226 of the Constitution of India, the petitioner has sought a direction for disposal of his application/representation to the District Panchayat Raj Officer, Jaunpur and plea taken is that there is a Government Order dated 16.8.2014 pursuant to which his application/ representation can be considered.
From a careful reading of the said Government Order dated 16.8.2019, copy of which has been supplied to this Court today, we find that the application/representation in cases of delimitation or reconstitution of Gram Panchayat can be considered and moved either by the Gram Panchayaat or the villagers of the Gram Panchayat if they are more than 50 in number, but in the present case we find that there are only ten villagers who signed the application.
Be that as it may, in our considered opinion the Government order is enforceable in such matters if the minimum requirement as provided for under sub Clause (1) of Clause 2 of the Government Order the condition stands fulfilled, which we find lacking in the present case. The writ petition is accordingly, dismissed at this stage.
