The petitioner has sought a direction in the nature of mandamus to release the F.D.R. dated 11.05.2017 which he has deposited with the respondents, his former Employers in compliance with their recovery order dated 28.06.2018 passed against him, which has been challenged before this Court by the petitioner in Writ-A No. 2288 of 2019. This Court has issued notice and stayed the operation of the order dated 28.06.2018 till the next date of listing.
Now, the petitioner has come up seeking a mandamus to release his F.D.R. dated 11.05.2017 deposited in connection with the said recovery. In the opinion of this Court the relief now sought is an integral part of the cause of action involved in the earlier writ petition regarding which the petitioner ought to seek relief in pending Writ-A No. 2288 of 2019.
Accordingly, this writ petition is dismissed with liberty to the petitioner to move an appropriate application in Writ-A No. 2288 of 2019 Order Date :- 20.12.2019 Deepak
