Heard learned A.G.A. and perused the criminal revision as well as judgement and order dated 17.06.1989 passed in Criminal Revision 16/89.
The brief facts of the case is that this revision filed against a complaint against Saeedul Islam opposite party no. 1 under Section 406/20 of I.P.C.
Learned Magistrate fixed the date for charge under Section 406 of I.P.C. against opposite party no. 1 and under Section 420 of I.P.C. against the said judgement and order passed by learned A.G.A. Opposite party no. 1 filed a revision before the learned Sessions Judge for quashing of order of the learned Magistrate.
The said revision has been decided by the order and judgement and dated 17.06.1989 passed by learned Sessions Judge, Moradabad which is under challenge in the present criminal revision.
After hearing the learned A.G.A. and going through the records of Court taken in the present criminal revision, I do no find any illegality in the judgement dated 19.06.1989.
From the above, the criminal revision is hereby dismissed.
