Heard learned counsel for the petitioner and the learned Counsel for the opposite parties.
Learned counsel for the petitioner states that charge of the post of the Secretary is being held in officiating capacity and no cadre Secretary has been posted up till now. His further submission is that the petitioner has been removed from the post and after his removal the post is being held in officiating capacity as such the post is vacant.
The argument of the learned counsel for the opposite parties is that transfer has been affected in pursuance to the Rules of 2003. But after the dismissal has been set aside the charge of the post is being held in officiating capacity.
Therefore, the opposite parteis will comply the order of this Court by posting the petitioner in the same Society.
