Heard learned counsel for the petitioner and learned Standing Counsel appearing for the State respondents and perused the record.
Sri Deepak Gaur has accepted notice on behalf of the respondent-Gaon Sabha.
Present petition has been filed for directing the Up-Ziladhikari, Tehsil Kalpi, District Jalaun at Orai to decide the demarcation application of the petitioner being Case No. NIL of 2019 (Jagdish Prasad and others vs. Govind Das and others) under Section 24(1) Land Revenue Act, within stipulated period.
Pursuant to the order dated 13.9.2021 learned Standing Counsel has produced a copy of the instruction dated 24.9.2021, which is taken on record. According to the instructions case number (No. 2144 of 2021, Computerized Case No. T202106350402144) has already been allotted to the proceedings filed under Section 24 of the Act and next date fixed is 18.10.2021.
In such view of the matter, no fruitful purpose would be served by keeping the petition pending.
In the facts and circumstances of the case, the present petition is finally disposed of with the direction to the respondent no. 1-Up-Ziladhikari, Tehsil Kalpi, District Jalaun at Orai to expedite the hearing of the aforesaid case and decide the same on its own merit, in accordance with law, expeditiously preferably within a period of three months from the date of production of self- attested copy of this order, which may be verified from the official website of this Court, provided the functioning of the authority concerned is not affected due to any reason related to Covid- 19 Pandemic as well as the lawyers are not abstaining from the work.
It is further provided that the dates on which the lawyers are abstaining from work shall be treated to be excluded from the period within which the proceedings are directed to be completed and in case the petitioners appear in person, the authority concerned shall proceed to conclude the proceedings.
With the aforesaid observations/ directions, the present petition is finally disposed of.
