Order on Civil Misc. Delay Condonation Application no.90341 of 2015 This is a delay condonation application filed in aid of belated Civil Misc. Substitution Application no.90343 of 2015 to bring on record heirs of the deceased respondent, who are proposed to be substituted as respondent nos.1/1 to 1/5.
Vide order dated 19.07.2018, the petitioner was permitted to take steps to serve the proposed respondents by publication as they were avoiding service of notice. A perusal of the office report dated 27.08.2018 shows that the petitioner has not taken steps to serve the proposed respondents by publication.
This case has come up virtually on the office report dated 27.08.2018. Mr. R.S. Kushwaha, learned Counsel appearing for the petitioner states that as he has lost contact with his client and has no further instructions in the matter.
In view of the said fact, this delay condonation application is dismissed for non-prosecution.
Order on Civil Misc. Substitution Application no.90343 of 2015 The delay condonation application being dismissed by an order of date, this substitution is rejected as time barred.
