JUDGMENT / ORDER

Court No. - 34
Case :- WRIT - A No. - 12842 of 2003 Petitioner :- Jagdish Prasad Saxena Respondent :- Secretary, Basic Education Board, U.P. Allahabad And Others Counsel for Petitioner :- Gulab Chandra,P. Kumar Counsel for Respondent :- C.S.C.,K. Shahi,Subodh Kumar
Hon'ble Sudhir Agarwal,J.
1. Called in revise. None appeared to press the writ petition. In the circumstances, I myself have perused the record.
2. By means of present writ petition, petitioner has sought following reliefs:
"(i) Issue a writ, order or direction in the nature of mandamus commanding the concerned respondents to ensure appropriate pay scale Rs. 7300/- per month in pursuance to Vth Pay Commission report and to consider the past services and to include them in consideration and to provide arrears of salary and other permissible benefits to the petitioner as per law.
(ii) Issue a writ, order or direction in the nature of mandamus commanding the concerned respondents to review and consider the work and services of the petitioner and to remove discrimination and to ensure payment of appropriate pay scale with arrears to the petitioner within time fixed by this Court with proper interest thereon.
(iii) Issue a writ, order or direction in the nature of mandamus commanding the concerned respondents to here and decide the representation dated 27.11.2002, 16.12.2002 and 15.1.2003, respectively with reasoned speaking order and to communicate the decision to the petitioner within appropriate time as may be fixed by this Hon'ble Court"
3. I myself have gone through the pleadings, grounds as also reliefs sought and find that petitioner is not able to make out a case so as to justify interference of this Court by granting relief as prayed for.
4. Moreover, it appears that either the cause of action no more survives or the petitioner has lost interest in this matter or it has otherwise become infructuous and probably for this reason, none is interested to have decided this matter on merits and that is why, counsel for petitioner is absent.
5. Dismissed. Interim order, if any, stands vacated.
Order Date :- 26.4.2018 Ravi Prakash
