This application u/s 482 Cr.P.C. has been filed seeking the direction to expedite the proceedings of Criminal Case No.1546 of 2009 (State of Uttar Pradesh vs. Bhuwra and others), arising out of Case Crime No.462 of 1995, u/s 504, 506 I.P.C., Police Station-Sarai Inayat, District-Allahabad, pending in the court of learned Additional Chief Judicial Magistrate, Court No.9, Allahabad.
Heard applicant's counsel and learned A.G.A. for the State. Record has been perused.
It has been made to appear that this matter relates to an F.I.R. lodged in the year 1995. The matter is still pending in the court. In absence of complete record this Court is not in a position to know the exact reason for this long pendency and therefore no specific orders are being passed. Counsel appearing on behalf of informant-applicant seeks direction to expedite the proceedings pending in the court concerned.
In the facts and circumstances of the case, this application stands disposed off with the direction that the lower court concerned shall make all sincere endeavours to expedite the proceeding of the aforesaid case at the earliest without granting any unnecessary adjournment to either of the parties, unless there is some legal impediment or unless there is any order passed by the higher court staying the proceedings of the case.
The court concerned is required to treat this matter as most urgent and must adopt all possible measures permissible under law to bring the proceedings of the case to their logical conclusion at the earliest.
