Vide order dated July 30, 2004, further proceedings were stayed.
From the office report, I find that in compliance of order dated 15.9.2009, the petitioner was required to take steps to serve respondent no.2. The needful was not done and, therefore, the matter has been placed before this court.
It appears that having obtained stay of further proceedings, petitioner wants to delay the proceedings.
The order of stay dated July 30, 2004 is hereby vacated.
Let the steps to serve respondent no.2 be taken within two days from today.
In case, needful is not done within two days, this petition would be deemed to be dismissed, without reference to court.
Let a copy of this order be conveyed to the court below.
