Heard learned counsels for the parties.
As per the instructions obtained by learned Standing Counsel Sri Anil Kumar Pandey, the order of the writ Court dated 22.01.2021 has been complied with by passing the order on the representation of the applicant on 20.02.2021. Copy of the instructions is supplied. He further submits that after the order passed on 20.02.2021 by the Additional Director, Treasury and Pension, Gorakhpur Region, Gorakhpur for forwarding documents regarding qualifying service of the petitioner for pension, the District Magistrate took a decision in the matter on 05.07.2021 and held that the petitioner's period of service is not enough to qualify for pension and this has been communicated to the petitioner by the order of Sub Divisinal Magistrate concerned on 05.07.2021. Copy of the instructions has been passed on to learned counsel for the petitioner in the court itself.
Since the order of writ court was confined to the decision on the representation only and the representation has been decided holding the petitioner not having qualifying service for pension, if the petitioner has the grievance that the entire calculation has been wrongly done by the District Magistrate concerned, he has an opportunity to challenge the order of the District Magistrate and the consequential order of the Sub Divisional Magistrate in appropriate proceeding at appropriate forum.
Contempt application is accordingly consigned to record.
