JUDGMENT / ORDER

Hon'ble Devendra Kumar Arora,J.
Issue notice to the opposite parties.
List after service report.
Heard Mr. J.N. Mathur, learned Senior Advocate assisted by Mr. Manish Mathur, learned counsel for the petitioner.
The petitioner being a tenant is seeking protection from the eviction of House No.42/61, Ram Ratan Bajpai Road, Peerpur Square, Narhi, Lucknow on the ground that till date possession of the property in question has not been taken by the Bank and if so the petitioner being tenant has right to protect from eviction by virtue of Section 3 (a) (1) and Section 14 read with Section 20 of U.P. Act No. 13 of 1972. Considering the facts and circumstances of the case, we hereby issue an interim mandamas to the opposite parties not to evict the petitioner from the House No.42/61, Ram Ratan Bajpai Road, Peerpur Square, Narhi, Lucknow till further orders of the Court.
Four weeks' time is granted to the opposite parties to file counter affidavit.
