1. Heard learned counsel for the parties.

Upon instructions, learned counsel for the respondent bank states that on the strength of documents produced by the petitioner, it appears that the total land holding of the petitioner exceeds the limit of 5 acres prescribed for the purpose of loan waiver scheme. It has therefore been suggested that the petitioner is ineligible to the aforesaid scheme.
3. Learned counsel for the petitioner disputes the correctness of the instructions so received. He submits that subsequent to the mutation proceedings, the agricultural holding of the petitioner is below 5 acres.
4. In such factual dispute, no useful purpose would be served in keeping the present petition pending. The present petition is disposed of with the direction that in case the petitioner files a proper representation in this regard before the respondent bank disclosing the full particulars of the agricultural holding standing in his name, the respondent bank after issuing a proper notice to the petitioner may decide such claim and determine the rights of the petitioner accordingly. If such representation be filed by the petitioner within a period of three weeks from today, along with certified copy of this order, it is expected that the respondent bank will take a final decision in this regard within a period of three months from the date of filing of that representation.
