Heard learned counsel for the petitioner and learned Standing Counsel appearing for the State respondents and perused the record.
Present petition has been filed with following prayer:-
"to issue a writ, order or direction in the nature of mandamus directing the respondent no. 2 to issue a corrected Intermediate Marksheet to the petitioner wherein his mother's name is correctly transcribed as "RAJVINDER KAUR" within a stipulated period of time."
It is submitted that petitioner's mother name has been incorrectly transcribed in the intermediate mark-sheet whereas the same has been correctly shown in the high school mark- sheet issued by the Central Board of Secondary Education, Delhi. He submitted that mistake is purely clerical in nature.
Learned counsel for the petitioner has placed reliance on a judgment of Hon'ble Division Bench passed in the case of Anand Singh Vs. U.P. Board of Secondary Education And 2 Others reported in 2014 (3) ADJ 443 (DB) and submitted that this mistake can be corrected being clerical in nature under Regulation 7 proviso of the Regulation framed under the Intermediate Education Act, 1921.
Learned Standing Counsel submitted that grievance of the petitioner can be suitably redressed by the respondent no. 2.
The petitioner has already filed a representation dated 28.6.2021 before the respondent no. 2.
Learned counsel for the petitioner submitted that this mistake in the monther's name was realized by the petitioner when he was going to apply in the University of Melbourne, Victoria, Australia, for higher studies and therefore, he immediately apply for correcting the same. Pressing the urgency that the date of petitioner's Visa may expire if the representation is not considered by the concerned authority, it is submitted that his representation may be decided at the earliest and within the shortest possible time.
In such view of the matter, present petition stands disposed of with a direction to the respondent no. 2, Secretary, Board of Intermediate and Secondary Education, Sarojini Naidu Marg, Prayagraj to consider and decide the representation of the petitioner as expeditiously as possible preferably within a period of 15 days from the date of production of self- attested copy of this order, which may be verified from the official website of this Court.
The petitioner is at liberty to file a fresh representation before the authority concerned along with self- attested copy of this order.
With the aforesaid observation/ direction, present petition stands disposed of.
