Heard learned counsel for the applicant, Sri Baleshwar Chaturvedi, learned counsel has put in appearance on behalf of opposite party No.2 and learned A.G.A. for the State.
The present 482 Cr.P.C. application has been filed to quash the charge sheet dated 6.12.2017 and entire proceedings of Case Crime No. 231 of 2017, under Section 135 of Electricity Act, P.S. Aata, District Jalaun pending before Special Judge (E.C. Act), Jalaun at Orai.
Learned counsel for the applicant submits that applicant is living separately from his father and connection is in the name of his father. It is further submitted that the liability has been imposed by the opposite party No.2 against him when he is not the consumer of the opposite party No.2.
In that view of the matter, applicant is permitted to move discharge application within one month from today through counsel before the Trial Court and the Trial Court shall decide the same within a period of two months from the date of filing of application along with certified copy of this order.
Till the discharge application is decided, no coercive measures shall be taken against the applicant.
With the aforesaid direction,the application is disposed of.
