Heard Sri Vinod Sinha, learned counsel for the petitioners, Sri Alok Singh, Advocate, holding brief of Sri Ramendra Pratap Singh, learned counsel for the respondent nos. 2 and 3 and Sri Raghvendra Dwivedi, learned Standing Counsel appearing for respondent no. 1.
As per the averments mentioned in the writ petition, petitioner no. 1 is the owner and bhumidhar of plot no. 422 situated at Village Sunpura, Tehsil Dadri, District Gautam Budh Nagar. In the present writ petition no material or documents have been filed by the petitioners to show and substantiate that the land in question is recorded as 'Abadi' and it is also not disputed that the area in question is not within the purview of the Greater Noida Authority. Petitioners have raised construction over the area in question without obtaining permission or approval from the respondent nos. 2 and 3 and, therefore, the area aforesaid has been demolished.
Considering the aforesaid, in absence of any sanction or approval from the Greater Noida Authority, no relief, as claimed by the petitioners, can be granted by this Court.
Writ petition has no merit and same is, accordingly, dismissed.
