Heard Shri Rajeshwar Singh, learned counsel for the revisionist, Shri Neeraj Tripathi holding brief of Shri Raj Kumar Kesari, learned counsel for the opposite party no.2.
This criminal revision is directed against the judgment and order dated 07.03.2017 passed by learned Principal Judge, Family Court, Gautambudh Nagar in case no.219 of 2013, under section 125 Cr.P.C., Police Station Bisrakh, District Gautam budh Nagar awarding the wife maintenance in the sum of Rs.4000/- per month from the date of judgment. This Court by an order dated 10.5.2017 referred the parties to the Mediation Centre to workout, if possible, an amicable settlement. The parties have appeared before the Mediation Centre and there is a report dated 24.10.2017 which says "Mediation Completed. No agreement."
Learned counsel for the opposite party no.2 is granted three weeks time to file a counter affidavit.
It is made clear that there is no interim order granted by this Court and the opposite party no.2 is free to take steps to execute the maintenance order in the meanwhile.
