The petitioners herein seek for quashing of the First Information Report dated 25.07.2021 registered as Case Crime No.0234 of 2021 under Sections 147, 149, 323, 504, 506, 308 I.P.C P.S-Utraon District-Prayagraj.
The contention of learned counsel for the petitioners is that the petitioners have not named in the first information report. Their names have come up in the statement of the co-accused. The allegations in the first information report did not make out commission of cognizable offence.
All these submissions of learned counsel for the petitioners are found misconceived, in as much as, it is admitted that the implication of the petitioners is based on the statement of the co-accused during the course of investigation.
From a perusal of the first information report, it cannot be said that it does not disclose commission of a cognizable offence.
Any interference, at this stage, may impede the speedy investigation.
The writ petition is thus found devoid of merit and hence
dismissed.
