Heard learned counsel for the petitioners; the learned Standing Counsel for the State-respondents 1 to 4; and perused the record.
The prayer in this petition is to command the second respondent to take a decision on the representation of the petitioners dated 11.08.2020 and to restrain the respondents from raising boundary wall on the land of the petitioners.
From the record, it appears that the claim of the petitioners before the Collector, Gorakhpur is in respect of his Plot No. 279 Mi and the allegation is that Ramleela Committee is seeking to illegally utilize the plot of the petitioners for raising boundary wall.
Ramleela Committee is not a party respondent and as the prayer made in the petition is in respect of enforcement of property rights, the appropriate course for the petitioners is to institute a suit for injunction or such other relief, as may be advised.
With the aforesaid liberty and without expressing any opinion on the merits of the claim, the petition is disposed off.
