None appears from the side of the revisionist. Sri Deepak Mishra, learned A.G.A. for the State is present.
This Revision has been filed with a prayer that the record of court below may kindly be summoned after summoning the records, the summoning order passed by the C.J.M., Moradabad sated 17.07.1992 in Case No. 4764 of 1992, (State Vs. Nasir and Other) be set-aside and quashed. Simultaneously a prayer is also made that further proceedings pending in the Court.
By the impugned order, C.J.M. Moradabad had taken cognizance under Section 190(c) Cr.P.C. finding that prima facie case is made out against present accused Jagat Singh, Advocate District Court, Mordabad and co-accused Nasir, Anil Kapoor, Parasi, Mahesh Chand, Munshi Buddhram under Sections 468, 471, 198, 199, 200 r/w 120-B IPC because all of them had together conspired to prepare forged Khatauni and had produced before court false affidavits and false Jamanatnama with a view to getting accused persons released on bail.
At the time of admission, this Court had directed that further proceedings in case no. 4764 of 1992 under Sections 468, 471, 198, 199, 201 and 120-B shall remain stayed thereafter, it is apparent from order dated 14.2.2011 passed by this Court that the said stay order had been vacated, therefore, by now this revision might have become infructuous as since last seven years, there was no stay in the proceedings before the court below hence, the proceedings might have been concluded thus, this revision is dismissed as infructuous.
In case, any grievance is felt by the revisionist, he may approach this Court.
