Despite time granted no counter affidavit has been filed by the learned A.G.A.
Heard learned counsel for the applicants and learned A.G.A. for the State.
The instant anticipatory bail application has been filed with a prayer to grant anticipatory bail to the applicants, Jagat Singh,Deependra and Smt. Rashmi Devi, in Case Crime No. 278 of 2020, under Sections- 420 I.P.C. and section 25 of Mahatma Gandhi National Rural Employment Guarantee Act(Manrega Act), Police Station- Talbehat, District- Lalitpur.
Regarding construction of road a three members committee was constituted.Applicants are members of the committee.There is allegation that they have created confusion by inviting tender twice in the same newspaper.There is no allegation of financial irregularity against the applicants.
The applicants have already been enlarged on interim anticipatory bail by this Court by order dated 28.01.2021.
The order is confirmed.
Applicants will remain on anticipatory bail till cognizance is taken by the court on the police report u/s 173 (2) Cr.P.C. on same terms and conditions as mentioned in the order dated 28.01.2021.
The anticipatory bail application is allowed to the aforementioned extent.
