Heard Sri Akhilesh Singh, learned counsel for the petitioners, Sri R.C. Srivastava, learned counsel for respondent no.5, Ms. Archana Singh, learned A.G.A. for the State and perused the record.
This petition has been preferred for quashing of the impugned order dated 27.05.2019 passed by Additional Sessions Judge, Court No.9, Saharanpur in Criminal Revision No.102 of 2018 (Dhyan Singh & others Vs. State of U.P. & others), under Section 146(1) Cr.P.C., Police Station Deoband, District Saharanpur.
Considering the facts and circumstances of the case, as the matter is sub-judice before the Magistrate concerned, it is directed that the Magistrate concerned after hearing the parties shall pass appropriate orders in accordance with law within a period of three months from the date of production of a certified copy of this order before him. The prayer for quashing the impugned order is refused.
With the aforesaid observations, this petition stands disposed of.
