The order of transfer dated 8.8.2018 is under challenge in this petition, whereby the petitioner has been transferred from Local Intelligence Unit (LIU), Kanpur Nagar to the Unit at Fatehgarh. The order has been passed in public interest. The order of transfer is challenged on the ground that petitioner has 14 months left to retire and, therefore, in terms of the transfer policy dated 29th March, 2018, the petitioner ought not to have been transferred.
Learned Standing Counsel submits that grievance of petitioner shall be examined by the competent authority, in accordance with law.
In the facts and circumstances, noticed above, this writ petition stands disposed of permitting the petitioner to represent in the matter before concerned authority, alongwith certified copy of this order, within two weeks from today, in respect of his grievance annexing all relevant materials in support of his claim. In case such a claim is raised, the same shall be examined by the authority concerned, in terms of the transfer policy and in accordance with law, by passing an appropriate order, within a further period of two months, thereafter. Till a fresh decision is taken upon the petitioner's representation, the order of transfer, in so far as it relates to present petitioner, shall be kept in abeyance. The order impugned shall otherwise be subject to the orders passed by the authority concerned, in so far as it relates to present petitioner.
