Heard learned counsel for the petitioner and the learned Standing Counsel for the State.
Grievance of the petitioner is that the contesting respondent is illegally trying to construct a temple over Plot No. 306 which is Bhoomidhari land of the petitioner, as it is evident from the extract of Khatauni 1428F to 1433F (Annexure No. 1).
By way of present petition, the petitioner seeks indulgence of this Court in exercise of it's extraordinary jurisdiction under Article 226 of the Constitution of India to issue a mandamus against the private respondent, which is not permissible in the eyes of law. The petitioner can file a regular suit, for redressal of his grievance, before the competent court against the private person.
In view of the above, present writ petition is dismissed on the ground of availability of statutory alternative remedy.
