Heard learned counsel for the petitioner; Shri Sanjay Kumar Singh, learned Standing Counsel for the State respondents and Shri Vimlesh Kumar Rai, learned counsel for the third respondent.
Petitioner is before this Court assailing the order dated 20.11.2017 by which the application under Section 80(1) CPC in O.S. Misc. No.289/2017 has been rejected by the Civil Judge (J.D.), Sharki, Allahabad. Further prayer has been made to direct the parties to maintain status quo on the spot plot no.797 situated in Village-Mahewa (Kunjual Bais Ka Pura) Pargana Arail, Tehsil Karchana, District Allahabad.
This writ petition has been filed beyond period of one year and 179 days after lapse of period of limitation. Learned counsel for the petitioner has requested for condonation of this delay.
The petitioners have not sufficiently explained the delay in filing the writ petition and therefore, the request for condonation of delay is declined.
Accordingly, this writ petition is dismissed on the ground of delay and laches.
