Petitioner is seeking consideration of his claim to promote on the post of clerk grade-I from the post of clerk grade-II in Nagar Nigam, Varanasi under 3% Physically Handicapped quota.
The contention is that out of total 117 of clerk grade-II, 86 posts are being occupied by the incumbents working on the same, whereas 31 posts are still vacant. There is no description of the number of posts which would fall within promotion grade, however, it contended by the petitioner that posts in promotion quota are still vacant.
Be that as it may, in view of the prayer of the petitioner to command the respondent no.2, to consider his claim, without expressing any opinion on merits of the claim of the petitioner, it is provided that the respondent no.2, Municipal Commissioner (Nagar Ayukt), Nagar Nigam, District Varanasi consider the matter of promotion, within 3% physically challenged quota as against the posts which are vacant within the promotion grade, to the post of clerk grade-II. The exercise for promotion shall be completed, as early as possible, after consideration of claims of all the eligible candidates.
The writ petition is, accordingly, disposed of.
