Heard learned counsel for the petitioner.
This writ petition has been filed seeking the following relief:-
"(I) Issue a writ order or direction in the nature of mandamus commanding the respondent No. 2, (Tehsildar, Tehsil-Kasya, District- Kushinagar) to consider and decide the restoration application dated 22.06.2013 filed by the respondent no. 4 in Case No. 201805440403358 (Chandrawati Devi Vs. Lalita Devi) under Section 34 of Land Revenue Act, is pending till today, within short stipulated time to be fixed by this Hon'ble Court."
The petitioner is aggrieved as his mutation case filed in June 2018 has not been decided finally till date.
Perusal of the order sheet of the proceedings sought to be expedited reveals that on most dates, the matter has been adjourned on account of lawyers being on strike from three months.
The writ petition is disposed of with the observation that the respondent no. 2 should endeavour to decide the mutation case expeditiously provided the lawyers refrain from going on strike.
