Heard the learned counsels for the parties.
Mr.
S.V. Raju, learned Senior Counsel appearing for the applicant has referred to Section 260 of the Companies Act, 1956 and submitted that the record of the Registrar of Companies reveals that the applicant was not a Director of R.N. Infra Communications Private Limited from the year 2008 onwards, when the purchase order was placed; delivery was taken by the company; and the complaint impugned was filed for non-payment, etc. arising out of the commercial transaction. In support of his submission, learned counsel has relied on the decision of the Apex Court in the case of Maksud Saiyed vs. State of Gujarat, (2008) 5 SCC 668.
Considering the above, Rule.
Interim relief in terms of paragraph 8(b) till final disposal of the matter.
