Notice on behalf of opposite party No.1 has been accepted by learned Chief Standing Counsel.
Mr.Jaideep Narayan Mathur, learned Additional Advocate General appears on behalf of opposite party No.1 i.e. the Registrar, Cooperative Societies, Uttar Pradesh, Lucknow.
Notice on behalf of opposite party No.2 has been accepted by Mr.Rakesh Kumar, learned Advocate and on behalf of opposite party No.3 notice has been accepted by Mr.Dinesh Kumar Pandey, learned Advocate.
Issue notice to opposite party No.4.
The petitioner claims that the opposite party No.4 has formed a Committee of six members including him under his Headship and has taken some decisions, which are detrimental to the interest of the Society i.e. the Northern Railway Primary Cooperative Bank Ltd., whereas still the Society on being elected on 19.6.2009 is functioning under the strength of the order passed by this court on 25th of May, 2009 in writ petition No.4622(MB) of 2009. He further informs that the period of Committee elected on 19.6.2009 is for five years. Accordingly he has raised the question on the authority of the opposite party No.4 to function as a parallel Committee.
Considering the facts and circumstances of the case we hereby restrain the opposite party No.4 to function alongwith other five members of the parallel Committee of the Northern Railway Primary Cooperative Bank Ltd. till further orders of this court by allowing the elected Committee of Management of Northern Railway Primary Cooperative Bank Ltd. elected on 19th of June, 2009 to function as such till further orders of this court.
Four weeks time is allowed to file the counter affidavit.
