The present writ petition has been filed against the order dated 6.11.2017 as well as the order dated 8.3.2019 passed by the Deputy Director of Consolidation, Lalitpur.
Through order dated 6.11.2017, the Deputy Director of Consolidation has set-aside the order dated 30.7.2016 passed by the Settlement Officer of Consolidation and has remanded back the matter to the Settlement Officer of Consolidation to pass fresh orders in accordance with law and on merits after hearing the concerned parties. The recall application filed by the petitioners for recall of the order dated 6.11.2017 has been dismissed by the District Magistrate, Lalitpur acting as a Deputy Director of Consolidation, Lalitpur vide his order dated 8.3.2019. The order dated 6.11.2017 is a remand order and does not finally decide the rights of the parties.
The petitioners shall have the opportunity to present their case on merits before the Settlement Officer of Consolidation and, therefore, it is not a fit case for interference by this Court under Article 226 of the Constitution of India.
The writ petition is dismissed.
