Heard learned Senior Counsel for the applicant and learned APP.
Enquiry Report [at page 47-50 of the compilation] prepared by the Assistant Commissioner of Police, 'G' Division, Surat, on prima-facie scrutiny of the record and statements of witnesses, reveals that the 'Will' was not forged or fake and, finally, FIR C.R. No.I-32 of 2012, impugned in this application, is registered with Rander police station for the offences punishable under Sections 406, 420, 467, 468, 471, 120B, 114 and 34 of the Indian Penal Code.
Considering the nature of dispute, remedies undertaken by the complainant earlier and no relief was granted, at this stage, a case is made out to issue notice returnable on 17.4.2012. Ad-interim relief in terms of paragraph 13(B).
Learned APP waives service on behalf of the State.
Direct service is permitted qua the private respondent.
