Public Prosecutor ORDER The present criminal original petition has been filed seeking to call for the records in C.C.No.175 of 2016 on the file of the Learned Judicial Magistrate at Avinashi, Thirupur District and to quash the same and to admit and contemplate the CCTV Surveillance Camera Recording Footage filed.
2. The learned counsel for the petitioner submits that the petitioner was the driver of the water Tanker lorry bearing Registration Number TN 33-A 5565 and on 26.05.2016 the Government Bus bearing Registration No. TN-30-N-1381 dashed the rear side of the Water Tanker Lorry which costs 3 lives and 5 persons were severely injured. The main contention of the petitioner is that there is no documentary evidence filed by the prosecution to show that he was solely responsible for the so-called accident. To the contrary the petitioner have enough unimpeachable materials to show that the petitioner was innocent in this case.
3. In the above circumstances, it is always open to the petitioner to make appropriate application before the concerned Court and to produce all the evidence before the trial Court and as such this petition is not maintainable before this Court.
4. Accordingly, this Criminal Original Petition is dismissed.
