JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE PARESH UPADHYAY) Rule.
Ms.Shah, learned APP, waives service of rule on behalf of the respondent-State.
By way of this application, the applicant-convict has prayed for temporary bail on the ground that he wants to attend the marriage of his brother's son which is scheduled on 27th February, 2011.
The ground is not such where the presence of the applicant can be said to be indispensable coupled with the fact that function is scheduled today i.e. 27th February, 2012.
Therefore, both on the ground that the presence of the applicant cannot be said to indispensable and also no useful purpose would be served by enlarging the applicant on bail, discretion does not deserve to be exercised.
Therefore, application is rejected. Rule discharged.
