Heard learned counsel for the applicant as well as learned A.G.A.
By means of the present application, the prayer sought by the applicant is to set-aside the impugned charge sheet dated 04.10.2018 as well as cognizance order dated 06.10.2018 in case crime no.314 of 2017, under sections 364 506 IPC and section 3(2)(V) of SC/ST Act, Police Station-Magorra, District- Mathura.
Submission made by learned counsel for the applicant is that the applicant has already been bailed out.
As the applicant has already been bailed out, he has every right to seek discharge in the light of the latest citations of Hon'ble the Apex Court.
Under the circumstances, the applicant, if so advised, may file discharge application and the same shall be decided by the learned court concerned as expeditiously as possible strictly in accordance with law.
With the aforesaid observations, the present application stands disposed of.
