Learned AGA for the State is present.
From perusal of the order dated 19.1.2019, it reveals that the case was passed over on the illness slip of Sri Ram Babu Sharma, learned counsel for the revisionist. But today also, no one appeared on behalf of the revisionist to press this revision.
This criminal revision has been directed against the order dated 29.8.2000 / 01.09.2000 passed by 6th Additional Additional District & Sessions Judge, Badaun in S.T. No. 352 of 1992, under Section 302 I.P.C., P.S. Zarif Nagar, District Badaun whereby trial court rejected the application of the applicant- revisionist to hold him minor.
Heard learned A.G.A. for the State and perused the record.
From the perusal of impugned order, material available on record and having heard the learned A.G.A., I see no illegality or irregularity committed by the Court below in passing the impugned order, even the revisionist is not able to make a fit case as to justify interference of this Court. I do not find any good ground to interfere in the same. No interference is warranted.
Moreover, it appears that either cause of action or any interest to the revisionist, no more survives or by efflux of time revisionist lost interest in the matter or it has otherwise become infructuous and probably for this reasons, none is interested to have decided this matter on merit and that is why counsel for the revisionist is absent.
Revision is dismissed accordingly. However, it is open to revisionist to approach this Court to recall the order, if any, interest or cause of action still survives.
