ORDER:
This Writ Petition is filed for the following substantive relief:
“to issue a writ or order or direction more particularly one in the nature of Writ of Mandamus, (a) to declare the levy of PDL and PCL Pennal charges to the petitioner cotton Ginning and pressing Industry is illegal and arbitrary as per the judgement of this Hon'ble Court without giving any notice or opportunity to the petitioner, (b) to declare the levy of PDL and PCL charges on the petitioner cotton Ginning and pressing industry as illegal when it is exempted from the preview of restriction and control measures until 31-03-2013 as per the proceedings of first respondent, and (c) to direct the respondents to adjust the PDL and PCL penal charges collected from the petitioner Rs.1,43,595/- towards 20% penal charges in the month of November 2012 consumption Bill in the future consumption bills as, it is collected arbitrarily on the seasonal industry of the petitioner in the November 2012 consumption bill and also not to collect any further amount towards penal charges of November 2012 consumption bill”
At the hearing, Sri K.V.Upendra Gupta, learned counsel for the petitioner, requested for permission of the Court to withdraw the Writ Petition.
The Writ Petition is, accordingly, dismissed as withdrawn.
As a sequel, WPMP.No.12411 of 2013 is dismissed as infructuous.
