JUDGMENT / ORDER

1. Pursuant to the order of this Court dated 19.12.2012, affidavit-in-reply is filed on behalf of respondent no. 1, Finance Department, through one Mr. R.G. Joshi, Deputy Secretary, Finance Department. The said affidavit-in-reply, inter alia reads, thus:

It is humbly submitted that the said order dated 31.5.2012 of Hon'ble High Court has been interpreted to mean that no termination of the part-timers is to be effected and that there is no stay against the G.R. dated 1.4.2010, under which the policy of outsourcing was framed by General Administration Department....
2. Prima-facie, the stand taken in this affidavit is in straight conflict with the letter and spirit both, of the order dated 31.5.2012 passed by this Court dealing with the policy of the Government of outsourcing.
3. The Additional Chief Secretary, Finance Department, who is in overall charge of the department, is directed to file affidavit to make his stand clear with regard to affidavit-in-reply dated 26.12.2012 sworn by Mr. R.G. Joshi, Deputy Secretary. The same may assist the Court further, while taking further action in the matter.
4. Learned AGP Mr. Soni prays for time. At his request, list on 22.1.2013.
