Jag Narain vs Basic Shiksha Adhikari & Ors

High Court Of Judicature at Allahabad|26 April, 2018
|

JUDGMENT / ORDER

Court No. - 34
Case :- WRIT - A No. - 11228 of 2002 Petitioner :- Jag Narain Respondent :- Basic Shiksha Adhikari & Ors. Counsel for Petitioner :- Surendra Prasad Counsel for Respondent :- C.S.C.
Hon'ble Sudhir Agarwal,J.
1. Called in revise. None appeared to press the writ petition. In the circumstances, I myself have perused the record.
2. By means of present writ petition, petitioner has sought following reliefs:
"(i) Issue a writ, order or direction in the nature of certiorari quashing the order dated 17.11.2001 passed by the respondent No. 3.
(ii) Issue a writ, order or direction in the nature of mandamus directing the respondent Nos. 1 to 4, not to make permit him to work as Assistant Teacher of the institution.
(iii) Issue a writ, order or direction in the nature mandamus directing the respondent No. 1 to hold an inquiry with regard to the relationship with the respondent No. 3 the Manager of the institution and appointment of respondent No. 5."
3. I myself have gone through the pleadings, grounds as also reliefs sought and find that petitioner is not able to make out a case so as to justify interference of this Court by granting relief as prayed for.
4. Moreover, it appears that either the cause of action no more survives or the petitioner has lost interest in this matter or it has otherwise become infructuous and probably for this reason, none is interested to have decided this matter on merits and that is why, counsel for petitioner is absent.
5. Dismissed. Interim order, if any, stands vacated.
Order Date :- 26.4.2018 Ravi Prakash
