Heard learned counsel for the petitioners.
The petitioners have come up in the present petition with a sole prayer that a direction be issued to respondent no.5-Additional District & Sessions Judge, Gautam Budh Nagar to decide the Civil Appeal No.02 of 2012 (Jagbhushan Garg and another Vs. Sirajuddin and others), under Section 96 of CPC expeditiously.
Considering the facts and circumstances of the case, without adverting into the merits of the case, the writ petition is disposed off with a direction to respondent no.5-Additional District & Sessions Judge, Gautam Budh Nagar to decide the Civil Appeal No.02 of 2012 (Jagbhushan Garg and another Vs. Sirajuddin and others), under Section 96 of CPC, pending before him expeditiously without granting any unnecessary adjournment to either of the parties.
In view of the fact that due to the pandemic of COVID-19, the certified copy is not being issued by the High Court, therefore, the order downloaded from the website duly certified by learned counsel for the petitioner may be treated as true copy of the order and the Authority may not refuse to comply the order on the ground of non filing of certified copy of the order.
