JUDGMENT / ORDER

Heard learned Counsel for the petitioner.
The grievance of the petitioner is that though His Excellency the Governor of Uttar Pradesh has recommended the case of the petitioner for appointment, yet the opposite parties are not offering appointment.
Learned Counsel for the petitioner submits that the petitioner having the qualification of M.A. (Sociology) with technical knowledge of Typing in Hindi submitted an application to the Hon'ble Governor of Uttar Pradesh with the prayer for his appointment on the post of Junior Clerk in the subordinate office of Collector, Ambedkar Nagar. The Secretary to the His Excellency Governor of Uttar Pradesh vide letter dated 26.12.1995 forwarded the petitioner's application to the District Magistrate, Ambedkar Nagar with the instructions to appoint the petitioner on the post of Junior Clerk.
A recommendation has been made to create Amedbkar Nagar in the year 1995. During the course of arguments, it has been admitted by the petitioner's counsel that His Excellency is not the appointing authority of the petitioner and it is only the District Magistrate to offer appointment for the post in question. As no order of appointment was ever issued from the office of the competent authority, question does not arise to allow the petitioner to work on the post in question on which he claims.
Accordingly, the writ petition fails and is hereby dismissed.
