Heard Shri Anil Kumar Srivastava, learned Senior Counsel assisted by Shri Manendra Pratap and Shri Prem Narayan Singh and Shri Ravi Yadav, learned counsel for the applicants and learned A.G.A. for the State.
The instant anticipatory bail application has been filed with a prayer to grant anticipatory bail to the applicants, Jafar Ali, Naki,Babar,Munnu and Musyyad in Case Crime No. 286 of 2020, under Sections- 147,148,149,307,352 I.P.C., Police Station- Jarcha, District- Gautam Budh Nagar.
The submission is that there are cross versions of the incident registered by both the parties. Injuries have been caused to both the parties. It cannot be ascertained at this stage which party was the aggressor.
The applicants have already been enlarged on interim anticipatory bail by this Court by order dated 04.02.2021.
The order is confirmed.
Applicants will remain on anticipatory bail till cognizance is taken by the court on the police report u/s 173 (2) Cr.P.C. on same terms and conditions as mentioned in the order dated 04.02.2021.
The anticipatory bail application is allowed to the aforementioned extent.
