Heard learned counsel for the applicant, learned AGA and perused the record.
By means of the instant 482 application, the applicant is challenging the veracity and validity of the Criminal Case No.489 of 2018 (State of U.P. Vs Zafar Ali), arising out of Case Crime No. 244 of 2017 under Section 138 of Electricity Act, P.S.-MundaPandey, District-Moradabad, pending in the Court of learned Additional District Judge IVth Moradabad and the impugned congnizance order dated 18.4.2018.
Sri Ram Chandra holding brief of Sri Pranjal Malhotra, submits that the offence is compoundable under Section 152 of the Electricity Act, if, the applicant approaches the authority concerned after depositing the fees of compounding within a period of two weeks from today, applicant shall be heard and decided by the competent authority mentioned in Section 152 of Electricity Act within a period of six weeks by a well reasoned and speaking order after considering the defence of the applicant.
With this observations, the application is disposed of.
During this period, no coercive action shall be taken against the applicant.
